Smile Zemi Home Trial

Please read these terms and conditions (the “Home Trial Terms”) that are applicable to a home trial for the Smile Zemi Tablets. In addition to these Home Trial Terms, the Smile Zemi Terms of Service and Additional Terms are incorporated into these Home Trial Terms by this reference. Terms not defined in these Home Trial Terms have the meaning set forth in the Smile Zemi Terms of Service and the Additional Terms (as Additional Terms is defined in such Terms of Service).

JustSystems America, Inc. ("we," "us," and "our") offers a trial period (as set forth below) for customers who purchase a new Smile Zemi Tablet, pursuant to which we will accept a return of the Returned Goods (defined below), a cancellation of the Smile Zemi subscription, and a refund of fees paid to us during the 21-day period beginning on the date the tablet departs our facilities (the “Departure Date”)and excluding any days during which the tablet was out of the initial purchaser’s hands for warranty repairs (the “Home Trial”). If the tablet does not reach you within ten days from the Departure Date and you notify us of this fact, then we will investigate the reason the tablet has not arrived and, if we find that the reason is not attributable to you, we will provide another tablet to you and offer you another 21-day trial period beginning on the Departure Date of such tablet under the above conditions.

Normally, customers are responsible for paying for the full term of a subscription and may only avoid paying for the full term of a subscription if they cancel prior to the renewal date (in accordance with the Smile Zemi Terms of Service). However, customers with contracts eligible for the Home Trial may receive refunds to the payment method selected at checkout in connection with the following conditions:

■ Contracts Available for a Home Trial:

New Contracts Only. Contracts for Smile Zemi that are renewals to existing contracts or new contracts for existing users are not eligible for a Home Trial.

■ Home Trial Period:

Cancellation forms (as described below) must be submitted by the customer within the 21-day period beginning on the Departure Date and excluding any days during which the Tablet was out of the initial purchaser’s hands for warranty repairs (the “Home Trial Period”).

■ Home Trial return policy:

Customers with contracts eligible for the Home Trial policy must satisfy each of the following four steps:

  1. Cancellation forms during the Home Trial must be submitted on the Parent Portal during the Home Trial Period.
  2. Customers must return the Smile Zemi tablet, AC adapter, pen, pen cord, cover, and documentation set (collectively, the “Returned Goods”) in the original packaging in which the tablet was shipped from us.
  3. Customers must cause the Returned Goods to arrive at the return address designated by us within fourteen (14) days after submitting the cancellation form. You will be responsible for the return shipping costs.
  4. The Returned Goods must be undamaged and in working order.

■ What is refunded:

Except as provided in the Special Circumstances section below, we will refund the initial purchaser’s payment method selected at checkout for the following amounts paid by the customer to us:

■ What is NOT refunded: Under no circumstances will we pay the customer for the following fees and costs:

■ Special Circumstances:

In the any of the following special circumstances, we will refund the initial purchaser’s payment method selected at checkout ONLY for the subscription fees paid by the customer to us, and the Tablet fees WILL NOT be refunded:

  1. When the Returned Goods do not arrive at our facility within fourteen (14) days after customers submit the Home Trial cancellation form;
  2. When the Returned Goods are inspected and found to be damaged or not working;
  3. When the Returned Goods are incomplete or missing; or
  4. When the Returned Goods differ from the tablet, pen, pen cord, cover, or AC adapter we shipped to you.

■ When Special Offers with Conditions are Applied:

In case the purchaser applied a special coupon that allows a discount under the condition of staying in the subscription for a designated period AND in any of the following special circumstances, the customer must pay a cost of the Smile Tablet, before any discount is applied, to get the subscription fees and Tablet fees paid by the customer refunded.

  1. When the Returned Goods do not arrive at our facility within fourteen (14) days after customers submit the Home Trial cancellation form;
  2. When the Returned Goods are inspected and found to be damaged or not working;
  3. When the Returned Goods are incomplete or missing; or
  4. When the Returned Goods differ from the tablet, pen, pen cord, cover, or AC adapter we shipped to you.
